Audience appearance release.

This is the full version of the terms you agree to when you reserve a seat at a Chronicle Cinema event or taping. It applies to you as an audience member. Performers and crew sign a different agreement.

The terms

1. What is happeningYou are attending a Chronicle Cinema event or production (the “Production”) as a member of the audience. The Production is being photographed, filmed, and audio recorded. Cameras are directed at the stage and at the audience, and you may appear or be heard in the recordings.
2. Rights you are grantingYou grant Chronicle Cinema, LLC and its affiliates, licensees, successors, and assignees (“Chronicle”) the irrevocable, perpetual, worldwide, royalty-free right to record, reproduce, edit, exhibit, distribute, and otherwise use your likeness, image, and voice in and in connection with the Production and any derivative works, in any media now known or later devised, including advertising, promotion, and behind-the-scenes materials.
3. No paymentYou will not be paid for your appearance, and you are not entitled to any residual or other payment. Admission to the event is the only consideration.
4. No approval rightsChronicle has sole discretion over whether and how your appearance is used, and is not obligated to use it at all. You waive any right to inspect or approve the finished material or the use made of it.
5. Who else this coversThe permissions and waivers in this release run to Chronicle and to the “Released Parties”: the performers appearing at the event and their respective production companies, representatives, and personnel; the venue and its owners and staff; and Chronicle’s affiliates, licensees, successors, assignees, officers, employees, and contractors.
6. Claims you are waivingYou agree not to bring any claim against Chronicle or the Released Parties arising out of the permitted use, including claims for invasion of privacy, right of publicity, defamation, or similar claims.
7. The material performedThis is live, unscripted comedy. It may include adult language and subject matter, may address topics you disagree with, and may involve interaction with the audience, including you. You release Chronicle and the Released Parties from any claim arising out of the content of the performance or out of anything said to or about you during it.
8. Your own conductYou are responsible for your own behavior at the event. If a claim is brought against Chronicle or a Released Party because of something you did, or because you broke a promise you made in this release, you agree to cover the resulting losses and reasonable costs.
9. Your authorityYou confirm that you are at least eighteen (18) years old, that you are attending voluntarily, and that you are free to grant these rights. Attendees under eighteen require a parent or legal guardian to sign a paper release at the door.
10. Electronic agreementAgreeing at registration is your written consent, given electronically, and has the same effect as a signature on paper. Chronicle keeps a record of that agreement, including the date and the email address used.
11. Other termsThis release is governed by the laws of the Commonwealth of Kentucky, and you consent to the exclusive jurisdiction of the courts located in Louisville, Kentucky. It binds your heirs and successors, and is the entire agreement between you and Chronicle on this subject.

If you’d rather not be on camera

Then this isn’t the event for you, and we’d rather say that here than at the door. A taping is not a show with cameras at the back. The audience is part of what’s being filmed, and there is no seat in the room that is out of frame. Come to something else of ours instead; we’ll have plenty.
